Terms of Service

These Terms of Service ("Terms") govern your use of Calem and any services purchased through it. By using our site or purchasing our services, you agree to these Terms.

1. Who We Are

Calem (calem.agency) is operated by Andrija Milosevic, an individual based in Belgrade, Serbia ("Calem," "we," "us"). Contact: hello@calem.agency

2. Our Services

Calem provides AI-generated business services, including:

• Strategy: brand positioning, target audience research, competitive analysis, brand voice guide, and strategy presentation deck ($800, per project)
• Branding: logo and visual identity, color and typography system, design style guide, and brand asset library, with 2 revision rounds ($800, per project)
• Website: a custom-built website (up to 5 pages), mobile-responsive, with basic SEO setup, domain and hosting setup, 1 revision round, and 14 days of post-launch support ($2,000, per project)
• Bundle: Strategy, Branding, and Website combined, with up to 8 pages, 3 revision rounds, and 30 days of post-launch support ($3,000, per project)

We also offer ongoing monthly plans:

• Maintenance ($120/month): managed hosting and SSL, uptime monitoring, and weekly backups
• AI Agency ($300/month): everything in Maintenance, plus AI agents working on your product and up to 10 change requests per month via in-app chat

Service details, pricing, and inclusions are as displayed on this site at the time of purchase and may be updated from time to time.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent.

4. Ordering and Payment

• Our order process is conducted by our online reseller Polar Software Inc. ("Polar"). Polar is the Merchant of Record for all orders. Polar handles payments, invoicing, taxes (VAT and sales tax), refunds and billing support. By purchasing, you also agree to Polar's terms of service.
• All project fees are billed upfront, per project, unless otherwise agreed.
• Monthly plans (Maintenance, AI Agency) are billed on a recurring basis and automatically renew until cancelled.
• We do not see or store your full payment card details.
• All prices are listed in USD unless otherwise stated. Applicable taxes are calculated based on your location and added at checkout.

5. Revisions

Each service tier includes a defined number of revision rounds, as specified in Section 2 and on our pricing section. A "revision" means a request to adjust delivered work within the original project scope. Requests that materially expand the scope (e.g., new pages, a different service category, or a substantially different direction) may be treated as a new project and quoted separately.

Once the included revision rounds are used, further changes are available through our AI Agency monthly plan or as a separately quoted project.

6. Delivery

We aim to deliver strategy, design, and development outputs promptly given the AI-driven nature of our process. Estimated delivery timeframes may be communicated during onboarding but are not guaranteed unless explicitly agreed in writing.

7. Ownership and Intellectual Property

• Upon full payment, you own the strategy documents, brand assets, and website source code delivered to you, free of ongoing licensing fees or platform lock-in.
• You are responsible for ensuring that any content, trademarks, or materials you provide to us for use in your project do not infringe on the rights of third parties.
• Calem retains the right to use anonymized, non-identifying information about completed projects for internal improvement and marketing purposes (e.g., aggregate statistics), unless you opt out by contacting us.
• We do not claim ownership over your business name, existing trademarks, or pre-existing materials you provide.

8. Acceptable Use

You agree not to use Calem to request or generate content that is illegal, infringes on third-party intellectual property or rights, is fraudulent, discriminatory, sexually explicit, or otherwise violates applicable law or these Terms. We reserve the right to refuse service or terminate an account for violations.

9. Refunds

• Before work begins: if you request a refund before we begin generating your deliverables, you are eligible for a full refund.
• After work begins, before delivery: refunds may be issued at our discretion, less any costs already incurred in producing your deliverables.
• After delivery: refunds are not provided. The revision rounds included with your service tier remain available to address concerns within the original project scope.
• Monthly plans can be cancelled anytime but are not refunded for the current billing period.

Refunds are issued through Polar to your original payment method. To request one, contact hello@calem.agency.

10. Subscription Cancellation

You may cancel your Maintenance or AI Agency subscription at any time through your account or by contacting hello@calem.agency. Cancellation takes effect at the end of the current billing period. If you cancel Maintenance, your website hosting and associated services may be discontinued; we will provide reasonable notice before this occurs where possible.

11. Disclaimers

• Calem's services, including AI-generated outputs, are provided "as is." While we aim for high-quality, professional results, we do not guarantee specific business outcomes (e.g., sales, traffic, conversions, or investment success) resulting from use of our services.
• We are not liable for decisions made based on strategy or research deliverables; these are provided as guidance, not professional legal, financial, or investment advice.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or related to these Terms or our services will not exceed the amount you paid for our services in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

13. Termination

We may suspend or terminate your access to Calem's services if you violate these Terms, engage in fraudulent or abusive behavior, or fail to pay applicable fees. You may stop using our services at any time, subject to the payment and refund terms above.

14. Governing Law

These Terms are governed by the laws of the Republic of Serbia. Any dispute will be resolved by the competent court in Serbia. If you are a consumer, this does not take away any mandatory protections you have under the laws of your country of residence.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new effective date. Continued use of Calem after changes take effect constitutes acceptance of the updated Terms.
